Family of Idaho cyclist killed in crash files $1 million lawsuit

NAMPA — The daughter of a cyclist who died after being hit by a vehicle driven by a Nampa employee has filed a $1 million claim against law enforcement and governmental entities.

Isabelle A. Alegria named the city of Nampa, the Nampa Police Department, the Canyon County Sheriff’s Office and Canyon County in her tort claim filed March 14. She asks for payment for damages related to a wrongful death and the medical care her father received after the collision.

The claim does not include allegations of wrongdoing by any of the agencies. It describes the death of 52-year-old Cruz Cantu Alegria, of Nampa, who on Nov. 10, 2016, was cycling east on Lone Star Road and crossing Midland Boulevard when a vehicle struck him in the crosswalk.

Cruz Cantu Alegria was injured in the crash and died six days later at Saint Alphonsus Regional Medical center in Boise, according to the claim. The total cost of his medical bills is still being calculated.

The vehicle that struck the victim was reportedly driven by Fawn Olk, a community service officer for the Nampa Police Department. Olk was driving her personal vehicle and was on her lunch break, Nampa spokeswoman Vickie Holbrook told the Idaho Press-Tribune in December.

In the wake of the crash, Olk was placed on paid administrative leave until Jan. 19, according to Nampa Human Resources and Information Technology Director Tina Combs.

The police department confirmed Tuesday that Olk is still employed by the city.

The incident was investigated by Idaho State Police to avoid a conflict of interest. That policy is standard for any case involving a city employee.

The results of the crash investigation were not available Tuesday afternoon, though the Press-Tribune put in a request with ISP. It is unknown if the investigation is complete.

No criminal charges have been filed against Olk, according to a search of Idaho court records.

The city and other entities named in the tort claim by Isabelle A. Alegria have 90 days to respond. If they deny the claim or do not respond, she would be eligible to file a lawsuit.
